Museum Wines respects your privacy and seeks to protect your personal data. The following information describes how we gather and use data. The amount of information Museum Wines holds on you and how it uses it depends on your relationship with Museum Wines and on what service you use, so some of the sections below may not be relevant to you.

We may process your order data. The order data may include your name, billing address, delivery address, phone number and email address. The order data will be processed for the purposes of delivering your wine orders to you. The legal basis for this processing is the performance of a contract between you and us.

The transaction data may include your name, billing address, delivery address, telephone number, email address and purchase history. It may be processed for the purpose of supplying the purchased goods or services and keeping proper records of those transactions. We may process information that you post for publication on our website, such as wall posts or product ratings and reviews (“internal social data”). This internal social data is public, and may be processed for the purposes of enabling interaction on the website or app between customers. We may also use your posts or reviews in our marketing materials to help us tell other customers about our products and services. In instances where internal social data is stored in an unstructured format (such as free text reviews and wall posts) it is exempt from our data retention rules, however may be deleted upon request. The legal basis for this processing is our legitimate interests, namely monitoring and improving our website and services.

We may process information contained in any enquiry you submit to us regarding goods and/or services (“enquiry data”). This enquiry data may be processed for the purposes of providing clarification, resolving issues or marketing relevant goods and/or services to you. The legal basis for this processing is the performance of a contract between you and us and to ensure we are responding to your enquiry.

The legal basis for this processing is our legitimate interests, namely the protection and assertion of our legal rights, your legal rights and the legal rights of others.

The legal basis for this processing is our legitimate interests, namely the proper protection of our business against risks.

We may update this policy from time to time by publishing a new version on our website. You should check this page occasionally to ensure you are happy with any changes to this policy.

Please do not supply any other person’s personal data to us, unless we prompt you to do so. If you do share your friends’ details with us, please ensure you have their authorisation.

What we use your personal information for

Museum Wines collects and uses your information to administer, support, improve and obtain feedback on our services and to detect and prevent faults, breaches of our network security, the law or our contract terms. If you are registered to use a service we may use the information you provide to us to carry out the service (please see the terms and conditions relating to that particular service) and we may contact you to obtain feedback on that service and any improvements we could make to it.

Further information/marketing

We may process information that you provide to us for the purpose of subscribing to our marketing communications and/or newsletters (“communication data”). The communication data may include your name, email address, postal address, phone number or marketing preferences. This communication data may be processed for the purposes of contacting you with service notifications, such as that your order has been processed, or contacting you with relevant offers and messages. The legal basis for this processing is performance of a contract for service notifications and legitimate interests for marketing communications.

We may process information that you provide to us for the purpose of improving our digital marketing (“digital marketing data”). We may use digital marketing data in a number of different ways: either to advertise our products and services to you on third party websites such as Facebook. The digital marketing data may include your name, email address, billing address, phone number, date of birth, gender, and the user ID of any social platforms you have connected with us on. The legal basis for this processing is our legitimate interests, namely providing better services and enhancing our customer base.

You have a right to ask us at any time not to contact you by way of direct marketing. You can do this by contacting orders@museumwines.co.uk with the words “personal details” in the subject line.

Personal Information Museum Wines collects

Museum Wines collects and updates information about users of its services. It may obtain this information via direct contact with you, from third parties such as other users and automatically via your use of our services.

Information you/others give us

This information includes your contact details, registration and payment details, support problems, details around participation in events, prize draws or surveys and certain relevant details of your preferences.

Information we collect via our services

If you are a registered user of Museum Wines services, Museum Wines also gathers information about your use of our services, such as generic types of data accessed, times and volume of use of the services and Traffic Data from the use of our Website. Traffic Data includes logs, details of networks, data and systems accessed, details of the sender and recipients of messages sent over our services, times and location of log on or access, duration of sessions, clickstream and similar usage or system data. Traffic Data may sometimes be traceable to/related to not just companies but named individuals. Before you register with Museum Wines for access to membership areas of our website, you can browse Museum Wines websites anonymously.

Upon request we provide site visitors with access to all information including proprietary information that we maintain about them (but not other users unless required to do so by law) including unique identifier information (e.g. customer number or password) and contact information (e.g. name, address, phone number). Users can access this information by e-mailing or writing to us. Upon request we offer visitors the ability to have inaccuracies corrected by providing such correct details to Museum Wines or where available by changing their registered details online.

How we use your information

For each visitor to Museum Wines website, Museum Wines Web server automatically recognises the users domain name. We also collect the e-mail addresses of those who communicate with us via e-mail and aggregate information on what pages users access or visit. Information volunteered by the user such as survey information and/or site registrations is also collected. The information we collect is used primarily for internal review and to improve the content of our Website & services. It is also used to notify users about updates to our services. This information is not shared with other organisations for commercial purposes. We do not, and will not, sell any of your personal data to any third party – including your name, address, email address or credit card information. We want to earn and maintain your trust, and we believe this is absolutely essential in order do that.

If you do receive unwanted email from us all our correspondence offers clear instructions on how to opt out. If you supply us with your postal address or telephone number you may receive periodic mailings or calls from us with information on new products and services or upcoming events. Storage methods and duration

Personal data that we process for any purpose or purposes shall not be kept for longer than is necessary for that purpose or those purposes.

If you have registered on our website but not purchased from us, the length of time we will retain your data is dependant on whether you have opted into our marketing communications. If you have opted in, we will retain your data for 2 years from registration; if you have not opted in, we will retain your data for 30 days from registration.

Whilst you are an active customer (which, for the avoidance of doubt, means you have purchased from us) we will retain your data for as long as needed to give you the best possible customer service. We will anonymise your personal data 7 years after your last transaction (sale or refund) provided you have not interacted with us for 2 years. For the purposes of this policy, an interaction is defined as an identifiable website or app session, or contacting our contact centre. We will inform you before we anonymise your data and give you the option for us to retain your details in order to continue to serve you.

In all instances outlined above, the process of anonymising your data may take up to one calendar month.

In certain circumstances we may retain your personal data where such retention is necessary for compliance with a legal obligation to which we are subject, to resolve disputes and enforce our agreements.

Passing your information to third parties

Except where the law permits or unless you specifically agree, Museum Wines does not sell or rent your personal data to others outside Museum Wines  We do not share or sell our customer list to any third party.

Cookies/Software agents

“Cookies” are pieces of software, which may be sent and recorded on your computer. These cookies enable us to collect information about how our websites and services are being used and to manage them more efficiently. Until you have registered on Museum Wines’ website, the cookie will only track general usage patterns and technical information about your computer type and will not be used to identify you individually. After registration, cookies will be used to collect information on you to facilitate your website experience.

You can turn off the ability to receive cookies by adjusting the browser on your computer but you should note that if you do so, this may materially distort the quality of service and data you receive. Cookies are not used to collect your personal information. Cookies are also used as a site security method to stop abuse of our subscriber service.

E-mail alerts, notices and newsletters

Museum Wines offers the opportunity for you to receive an e-mail newsletter or other notifications in relation to products being advertised on the Museum Wines website or new services being offered. You can at any time choose to stop receiving e-mail alerts or newsletters by following the instructions on the alert, notification or e-newsletter or by e-mailing info@museumwines.co.uk

Interception of mail

Museum Wines may intercept email addressed to individuals within Museum Wines  The reasons we do this are related to security of Museum Wines  its staff and others, for detection and prevention of crime and to identify correct recipients or to make sure mail is dealt with during staff absence. Museum Wines may reject, delay or remove content from emails which have a nature, content or attachments which may disrupt Museum Wines’ systems or because they may pose security issues such as viruses.

Museum Wines may also filter out emails which contain certain content on the basis that content is offensive or the email is unwanted or spam. In certain circumstances this may unfortunately result in “innocent” emails being affected, but Museum Wines does try to reduce such occurrences.

Security

Museum Wines has developed strict policies governing information technology. These cover areas such as access control, authentication, audit, monitoring, alarms, data storage and back up and transmission standards and environment integrity. Museum Wines will use reasonable endeavours to install and have appropriate security measures in place in Museum Wines’ facilities to protect against the loss, misuse or alteration of information that Museum Wines has collected from you at Museum Wines’ site.

We use the finest encryption systems available to ensure your credit card details are sent in a secure format. We make use of GeoTrust software for our encryption.

As an additional security precaution we do not store any credit card details on our website.

To assure you of our attention to these issues we belong to the ISIS (Internet Shopping is Safe) scheme and the Wine by Mail Order Code of Practice.

Name of company

Museum Wines means Museum Wines Limited and subsidiaries or corporate entities as they exist from time to time and in which Museum Wines has a direct or indirect ownership interest of 50% or more or who in turn control 50% or more of Museum Wines.

Questions & Your Rights

If you have any questions about Museum Wines privacy/data protection policy or the use of data in a particular service, you should write to Company Secretary , Museum Wines, The Old Calf House, Tarrant Hinton, Dorset, DT11 8JX. The law allows you to write and ask to see and correct the information held about you, although this may require payment of a reasonable fee.

Right of access

You have the right to confirmation as to whether or not we process your personal data and, where we do, access to the personal data, together with certain additional information. That additional information includes details of the purposes of the processing, the categories of personal data concerned and the recipients of the personal data. Providing the rights and freedoms of others are not affected, we will supply to you a copy of your personal data. The first copy will be provided free of charge. In order to fulfil this right we will ask for government registered ID to confirm your identity and, once this is received, will respond with the relevant information one calendar month from the date of your request.

Right to rectification

You have the right to have any inaccurate personal data about you rectified and, taking into account the purposes of the processing, to have any incomplete personal data about you completed.

Right to erasure

In certain circumstances you have the right to the erasure of your personal data without undue delay. However, there are exclusions of the right to erasure, such as where processing is necessary for exercising the right of freedom of expression and information, for compliance with a legal obligation, or for the establishment, exercise or defence of legal claims. If you have entered into a transaction with us, we will keep a record of your personal data for seven years following the date of your last transaction with us. We will endeavor to respond to your request within one month, but if your request is complex or we receive a number of similar requests at the same time, it might take us longer, in which case we will inform you within one month of the receipt of the request and explain why we think an extension is necessary.

Right to restriction on processing

In some circumstances you have the right to restrict the processing of your personal data. Those circumstances are: (a) you contest the accuracy of the personal data; (b) processing is unlawful but you oppose erasure; (c) we no longer need the personal data for the purposes of our processing, but you require personal data for the establishment, exercise or defence of legal claims; and (d) you have objected to processing, pending the verification of that objection. Where processing has been restricted on this basis, we may continue to store your personal data. Right to objection to processing

You have the right to object to our processing of your personal data on grounds relating to your particular situation, but only to the extent that the legal basis for the processing is that the processing is necessary for: (a) the performance of a task carried out in the public interest or in the exercise of any official authority vested in us; or (b) the purposes of the legitimate interests pursued by us or by a third party. If you make such an objection, we will cease to process the personal information unless (a) we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or (b) the processing is for the establishment, exercise or defence of legal claims.

You also have the right to object to our processing of your personal data for scientific or historical research purposes or statistical purposes on grounds relating to your particular situation, unless the processing is necessary for the performance of a task carried out for reasons of public interest.

Right to data portability

In certain circumstances, you have the right to receive your personal information in a structured, commonly used and machine-readable format and to transmit that information to another controller to enable it to use the data. The right to data portability applies (a) to personal data you have provided to us as data controller, (b) where the processing is based on the your consent or for the performance of a contract and (c) when processing is carried out by automated means. If you request this information, we will transmit the data directly to another controller, if this is technically feasible. We are, however, not required to adopt or maintain processing systems that are technically compatible with other controllers. Also, if the personal data concerns more than one individual, we must consider whether providing the information would prejudice the rights of other individuals.
